Terms & Conditions – G.A.I.N.S.

Article 1 – Definitions

In these Terms and Conditions:

• Entrepreneur: Vitalis Group B.V., trading under the brand name G.A.I.N.S., offering products and services to Consumers via its online store.

• Consumer: A natural person who is not acting in the course of a business or profession and enters into a Distance Agreement with the Entrepreneur.

• Distance Agreement: An agreement concluded between the Entrepreneur and the Consumer within the framework of an organized system for distance selling.

• Cooling-off Period: The statutory period within which the Consumer may exercise the Right of Withdrawal.

• Right of Withdrawal: The Consumer’s statutory right to withdraw from the Distance Agreement within the cooling-off period.

• Day: Calendar day.

Article 3 – Applicability

These Terms and Conditions apply to every offer made by G.A.I.N.S. and to every Distance Agreement concluded between G.A.I.N.S. and the Consumer.
Before concluding an agreement, the text of these Terms and Conditions will be made available to the Consumer electronically.

Article 4 – The Offer

• All offers on our website are non-binding and may be subject to changes or corrections.

• Product images are for illustrative purposes only.

• Obvious mistakes or errors are not binding on G.A.I.N.S.

• Each offer clearly states the total price (including VAT), shipping costs, and the applicable payment and delivery methods.

Article 5 – The Agreement

• The agreement is concluded once the Consumer accepts the offer and fulfills the conditions.

• When the Consumer accepts the offer electronically, G.A.I.N.S. will confirm receipt of the acceptance electronically.

• G.A.I.N.S. ensures appropriate security measures for electronic transactions and provides a secure online environment.

Article 6 – Payment

• Payment must be made immediately via the available payment methods (iDeal, PayPal, Credit Card, Apple Pay, Google Pay).

• In case of non-payment, G.A.I.N.S. may charge reasonable collection costs.

Article 7 – Shipping & Delivery

• Orders are shipped using PostNL or another carrier chosen by G.A.I.N.S.

• The Consumer is responsible for providing correct delivery details. G.A.I.N.S. is not liable for incorrect addresses provided by the Consumer.

• We aim to deliver within 30 days. If delivery is delayed beyond this period, the Consumer may cancel the agreement free of charge and receive a full refund.

Article 8 – Prices

• All prices shown on our website include VAT.

• Price increases after the agreement has been concluded are only permitted if required by statutory regulations.

Article 9 – Right of Withdrawal (Statutory 14 Days)

• Consumers have the right to withdraw from the agreement within 14 days of receiving the products, without giving any reason.

• For health protection and hygiene reasons, products that have been opened, unsealed, or used cannot be returned under this statutory right.

• To exercise the Right of Withdrawal, Consumers must notify us within 14 days by email (support@gains.eu).

• Products must be returned unused, unopened, and in their original packaging within 14 days of notification.

• Return shipping costs are borne by the Consumer.

• Refunds cover only the purchase price of the product(s). Shipping costs are not refunded.

• Refunds will be issued within 14 days of receiving the returned products, provided the above conditions are met.

Article 10 – Money Back Guarantee (30-Day)

In addition to the statutory Right of Withdrawal, G.A.I.N.S. offers a voluntary 30-Day Money Back Guarantee. To ensure fairness, the following conditions apply:

• The guarantee applies once per customer and to only one jar per order (including bundles).

• At least two-thirds of the jar must have been used, but the jar may not be completely empty when returned.

• Refund requests must be made within 45 days of purchase.

• Return shipping costs are the responsibility of the Consumer.

• Refunds cover only the price of the product. Shipping costs are not refunded. If the order qualified for free shipping, the actual shipping cost will be deducted from the refund.

• To request a refund, contact support@gains.eu with your order number, product name, and a short explanation of your experience. Refunds will be processed within 5–10 business days after receipt of the returned product.

Article 11 – Warranty & Complaints

• G.A.I.N.S. guarantees that its products comply with the agreement and the specifications mentioned in the offer.

• Complaints must be reported promptly after discovery by contacting support@gains.eu. We will assess the complaint and provide a suitable solution, which may include a replacement or refund.

• Consumers may also submit complaints via the European Online Dispute Resolution (ODR) platform: https://ec.europa.eu/consumers/odr/.

Article 12 – Disclaimer & Limitation of Liability

• G.A.I.N.S. products are dietary supplements and are not intended to diagnose, treat, cure, or prevent any disease.

• Information provided on our website, packaging, or in communications is for informational purposes only and does not replace medical advice.

• Always consult a doctor before using our products, especially if you are pregnant, breastfeeding, have a medical condition, or take medication.

• Use of our products is at your own risk. The Consumer is responsible for checking suitability for their own health and allergies.

• Liability of G.A.I.N.S. is limited to the purchase price of the product, unless damage is the result of intent or gross negligence.

Article 13 – Force Majeure

G.A.I.N.S. is not liable for failure to fulfill obligations due to force majeure, including but not limited to: internet disruptions, natural disasters, pandemics, strikes, or government actions.

Article 14 – Transfer of Ownership

Ownership transfers to the Consumer after full payment.
The risk of loss or damage transfers upon delivery.

Article 15 – Intellectual Property

All intellectual property rights relating to products, website content, and marketing materials remain the property of G.A.I.N.S. and Vitalis Group B.V.
It is prohibited to use, copy, or distribute content without prior written consent.

Article 16 – Applicable Law

Agreements between the Consumer and G.A.I.N.S. are governed by Dutch law.
For Consumers within the EU, mandatory consumer protection laws of their country of residence may also apply.
